Each state sets its own rules about what you pay a workers' comp lawyer, since this type of injury insurance is managed by the state. In Illinois, the lawyer's payment is 20 percent of the final settlement. So if $10,000 is recovered in the case, the lawyer gets paid 20 percent of that plus the cost of any expenses, and the rest goes to the injured worker.
