You don’t have to be the driver of the automobile in which you are in to collect damages. If you’re a passenger in someone’s car and someone else is at fault and they injure you, you’re entitled under the law to collect damages for said injuries, for your pain and suffering, for your lost wages, but yes, you can collect damages if you’re only a passenger in a car.
