Illinois does not currently have any motorcycle helmet statute. Therefore, it is not illegal to ride your motorcycle without wearing a helmet. If you are injured in a motorcycle crash caused by someone else’s negligence, you can still pursue compensation in a claim even though you weren’t wearing a helmet at the time.
It’s a really good idea to wear a helmet though. According to the National Highway Traffic Safety Administration, motorcycle helmets saved an estimated 1,859 lives in 2016. The NHTSA says another 802 people could have been saved that year if all motorcyclists had worn helmets. As experienced accident attorneys, we urge you to wear a helmet.
