What If I Wasn’t Wearing My Helmet in an Accident?

Illinois does not currently have any motorcycle helmet statute. Therefore, it is not illegal to ride your motorcycle without wearing a helmet. If you are injured in a motorcycle crash caused by someone else’s negligence, you can still pursue compensation in a claim even though you weren’t wearing a helmet at the time.

It’s a really good idea to wear a helmet though. According to the National Highway Traffic Safety Administration, motorcycle helmets saved an estimated 1,859 lives in 2016.
